Terms and Conditions: Hire, Self-Guided Packages and Tours
So you want to join us for an unbeatable adventure experience in this World Heritage wilderness region of Barrington Tops? Whether you are a Hire customer, or signing up for a Self-Guided Package or Guided Tour then these essential conditions relate to you.
Using equipment in the great outdoors is a potentially hazardous activity carrying a significant risk so make sure you read the information below before making your booking.

Before you begin:
To paddle kayaks or canoes you must weigh under 120kgs and wear closed in shoes or sandals with a heel strap (no thongs).
Age guidelines apply to kayak and canoe use on different sections of the river.
To use our mountain bikes you must be a minimum 152cm (5ft). Mountain Bike hire is restricted to use of equipment on the mountain bike tracks at The Steps of Girrba Campground.

If you have booked Hire or a Self-Guided Package all equipment is to be checked by the Client at the time of departure. No responsibility will be taken by BOAC for faulty equipment after departure. Any defect should be reported to management before departure. The Client also acknowledges that the equipment (which shall include all fittings, accessories and ancillary equipment taken by the Client) is the property of BOAC.
Returns and late fees
In the event of a Client failing to return equipment on or before the expiration of their scheduled booking period and not within regular business hours, a Late Fee will be charged. As our office hours are 9am to 5pm daily, it is required that equipment be returned to BOAC at 126 Thunderbolts Way Gloucester no later than 4:30pm on the stated date of return to allow time for the equipment to be checked, unloaded and stored securely by close of business.
Any equipment returned after this time will incur a penalty at a rate of $50 per hour per staff member required or part thereof. Any equipment not returned by 8.00pm will incur full hire charges for an additional day.
Should a client require unscheduled pick-up or additional assistance during their activity, whether by local Emergency Services or Barrington Outdoor Adventure Centre, then the client agrees to be responsible for all costs. In the event of the Client requiring assistance after the expiration of their Hire, Package or Tour period, then the Client shall be responsible for all costs in addition to incurring the Late Fee outlined above.
Loss or damage fee
In the event of the Client failing to return equipment to BOAC in good, serviceable condition the Client shall pay such sums as are required to restore the equipment to a good and serviceable condition. Should the equipment be in such a condition that it is unable to be reasonably restored, the equipment shall be deemed to be destroyed and the Client shall pay the cost of replacing the equipment with new equipment of a similar standard. If the equipment or any part thereof is not returned to the owner on or before the expiration of the Client’s scheduled booking period and not within regular business hours, the equipment shall be deemed to be lost and the Client shall pay to the Owner on demand the replacement cost of such equipment in accordance with the Owner’s schedule of replacement costs. Repair and replacement costs are charged at current retail prices as below.

Note: These items will be assessed by BOAC management based on the amount of damage caused by the hirer.
Risk – indemnity and liability
Nature is not a theme park and there are risks in hiring and using equipment, or participating in a guided tour, in the great outdoors. In using equipment from Barrington Outdoor Adventure Centre (BOAC), the Client agrees that they shall be responsible for all risks of, or in connection with, the use of the equipment including risks to third parties or their property. The Client also indemnifies the Owner against any claim action suit or charge, or sums payable, which may be claimed, incurred, or paid, by reason of the possession and use of the equipment by the client or anyone claiming, or using the equipment, with or without the Client’s permission.
Drugs and alcohol
No customer shall be allowed to participate in their booked activity if considered under the influence of drugs and alcohol. Management retains the rights to delay, reschedule or cancel a booking, without refund, if a Client should be considered to be under the influence of drugs and alcohol. Clients also agree not use any equipment while under the influence of drugs and alcohol. The Client assumes all insurance responsibility if using equipment under the influence of drugs and alcohol and the Client will ensure that anyone claiming, or using the equipment, with or without the Client’s permission is not under the influence of drugs or alcohol.
Management retains the rights to delay, reschedule or cancel a booking, without refund, if a Client, on request, cannot demonstrate and/or communicate an understanding of the safety information provided to them prior to their activity.
Variations – access and use
Whilst BOAC will endeavour to ensure you are able to use canoes or kayaks on your desired section of river, this cannot be guaranteed and Barrington Outdoor Adventure Centre reserves the right to add, withdraw, substitute and/or vary booked routes, prices and departure times for a Hire, Package or Tour without notice, due to inclement weather, safety, floods or low water or any other cause. Reasonable endeavours will be made to maintain arrangements as advertised. BOAC will notify you as early as possible of any required changes.
The Client shall not, without the written consent of the owner, assign or purport to assign this agreement or any of his or hers rights hereunder to any other party.
